ENROLLMENT POLICY
Admissions Consulting and tutoring are programs subject to student participation and attendance. You agree that Mavin Learning Resources offers no guarantee of any kind, whatsoever.

REFUND POLICY
All fees, once paid, are neither refundable nor transferable.

ARRIVAL AND DISMISSAL POLICY
You agree that Mavin Learning Resources is not responsible for the student once the student leaves Mavin Learning Resources’s premises. Mavin Learning Resources will not hold a student on its premises against the student’s will, even if a parent/guardian is not present to pick-up the student.

ABSENCE POLICY
Sessions may be rescheduled, but “no show” absences cannot be made up.

RENEWAL POLICY
Once your Tutoring service package runs out, we will contact you for possible renewal.

CANCELLATION OF LESSONS BY CLIENT/STUDENT
The Client/Student may cancel tuition/lessons by giving at least 24 hours prior notice to the Tutor in which case no tuition fees will be incurred. Lessons not attended by the student without giving 24 hours prior notice to the Tutor shall be charged at the full rate.

CANCELLATION OF LESSONS BY TUTOR
The Tutor may cancel lessons by giving 24 hours prior notice to the Client/Student in which case no fees shall be incurred. Where a lesson was prepaid, the Tutor shall reschedule the appointment at a time agreeable to both parties, failing to do so will result in the Client/Student given a refund.

LATE ARRIVAL
Fees are calculated according to the time stipulated in the schedule and no adjustment shall be made for time lost because of late arrival by the Student. Students who arrive late will only be tutored for the remainder of the scheduled session. There will be no prolonged sessions.

Any lost time because of the late arrival of the Tutor shall be compensated by extending a lesson by mutual agreement and by such an amount of time that was lost.

NO-SHOW POLICY
Students who are not present at the predetermined location when Tutor arrives or who are more than 15
minutes late are considered no-shows. If the Student is a no-show, he or she is still responsible for payment for the tutoring session. No discount or refunds shall be given in respect of lessons not attended by the Student.

Pay-per-session clients must present payment for the session in which he or she was a no-show and the following session in order for tutoring to continue.

MISSED SESSIONS
Because the nature of the tutoring sessions is to improve academic performance, it is pertinent that the Student attends regularly and on time. If there are 3 or more cancellations, no-shows, or tardies in any 2-month time frame, the client will be charged a $35 Convenience Fee for each 2-month occurrence.

INCLEMENT WEATHER
In the event of inclement weather (snow, sleet, hail, flooding, tornado, hurricane, severe thunderstorm) we will leave it up to the discretion of the Client/Student and Tutor as to whether or not a lesson will be held. All clients have the option to use online tutoring as an option in lieu of cancellation due to inclement weather. Please communicate with your tutor on lesson days when there is inclement weather. The Tutor shall reschedule the appointment at a time agreeable to both parties, should lessons be canceled due to inclement weather.

OBLIGATIONS OF THE STUDENT
• The Student undertakes to assist the Tutor in identifying problem areas in which the Student needs specific tutoring.
• The Student agrees to be prepared for every session by having all materials, utensils, homework, etc. ready and available in the designated tutoring location prior to the Tutor arriving.
• The Student agrees that assignments, exercises, or homework form an integral part of tutoring and
undertakes to complete such work in a timely manner.

OBLIGATIONS OF THE PARENT/GUARDIAN
• The parent/guardian undertakes to be responsible for the student’s conduct and character during the
tutoring sessions including promptness, respectful behavior, and staying on task.
• The parent/guardian is responsible for initiating any communication with the tutor.
• The parent/guardian is responsible for getting the student to the session on time and for picking up the student promptly as soon as the session has ended.
• The parent/guardian agrees to ensure that the student has completed all work assigned by the tutor
within the time frame given.

OTHER TERMS & CONDITIONS
Mavin Learning Resources, at its sole discretion, may deem a child inappropriate for its program. In such a situation the child will not be allowed to continue with the program, Mavin Learning Resources will refund an unspecified amount for all unused services within 30 business days. The family will have no recourse other than this refund.

In the event that Mavin Learning Resources may choose to substitute a different teacher, Mavin Learning Resources will make every effort to notify the families in advance of such changes. If there is a permanent change regarding private tutors, the family will be notified and informed of the situation.

In the event that Mavin Learning Resources deems it necessary to cancel or discontinue a class, Mavin Learning Resources’ sole obligation will be to make an appropriate effort in providing the family with a comparable tutor OR notifying family in advance of such circumstances.

The total claims of the family, with respect to issues of Professional Liability, will be limited to the amounts paid for the tutoring in question. No claims for refund shall be valid after the completion of the tutoring.

RELAXATION OF TERMS
No relaxation, indulgence, waiver, or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.

AGREEMENT FOR PAYMENT
Payment shall be made before the start of a tutoring session OR Payment shall be made weekly/monthly in advance. Students who wish to reserve a definite weekly time slot for private tutoring sessions, need to prepay for a set of tutoring sessions. The prepaid sessions will be valid for one year. During this period, if students need to cancel or reschedule sessions, they need to notify Mavin Learning Resources 24 hours in advance within business hours.

Should you choose to cancel a prepaid Learning Package after attending your first session, you will be billed for the remaining amount of the Tutoring Package price. Exceptions may be made only in cases in which a student cannot attend due to serious illness or the death of an immediate member of the student’s family.

In order to reserve a space prior to the start of either the Spring, Summer, or Fall terms, all pages of this
application must be completed in full, signed in the appropriate places, and accompanied by full payment in the form of either a (1) check or (2) credit card information and signature authorization.

LATE PAYMENT POLICY
Payment will be collected before the start of each session. Failure to provide payment will result in canceled sessions and/or disenrollment from the program.

Checks returned due to insufficient funds will be assessed a $50 penalty. These amounts must be paid along with tuition to Mavin Learning Resources in cash or by credit/debit card. No further tutoring sessions will be scheduled until all charges are paid, as set forth above.

PHOTO RELEASE POLICY
Mavin Learning Resources Inc. has permission to use my or my child’s photograph publicly to promote the Mavin Learning Resources Inc.
I understand that the images may be used in print publications, online publications, presentations, websites, and social media. I also understand that no royalty, fee or other compensation shall become payable to me by reason of such use.

WAIVER OF LIABILITY/HOLD HARMLESS ACKNOWLEDGEMENT
Student’s parents and/or legal guardians acknowledge that no warranty or guarantee, express or implied, is made as to any student’s success or performance on any test or in any other procedure or
process designed to assess a student’s intelligence, knowledge and/or academic abilities and hereby waives any such warranty or guarantee existing by operation of law.

Student’s parents and/or legal guardians further acknowledge that a student’s failure to perform on any test or in any other procedure or process designed to assess a student’s intelligence, knowledge, and/or academic abilities at the level expected shall not constitute a breach of this contract nor any other legally cognizable cause of action against Mavin Learning Resources, Inc., or any of its Officers, Directors, Employees, Independent Contractors, or Agents.

Students, parents, and/or legal guardians hereby release and discharge Mavin Learning Resources, Inc. its Officers, Directors, Employees, Independent Contractors, and Agents from any and all liability for injury and/ or damages allegedly arising out of student’s failure to perform at any defined level on any such test or other procedure or process designed to assess a student’s intelligence, knowledge and/or academic abilities.
